New York Introduces Uncontested Joint Divorce
- posted: Jul. 18, 2025
New York State lagged behind the rest of the nation when it came to introducing no-fault divorce. Finally in 2010, the state gave residents the ability to dissolve their marriages without accusing their spouse of misconduct or abandonment. Though New Yorkers can still use one of four fault-based grounds, most couples have opted to divorce by declaring that their marital relationship has been irretrievably broken for at least six months. Now, the Empire State has introduced uncontested joint divorce, a new method of divorce designed to streamline the legal process for couples who agree on all financial and parenting terms.
However, it's crucial to consult a knowledgeable divorce lawyer before you make a decision on the proper method of marriage dissolution. Most husbands and wives enter their divorce saying that they want to finalize things quickly and without unnecessary conflict. While these are admirable objectives, there are situations where spouses make choices that hurt them in the long run because they want to “get things over with.” Don’t agree to a settlement through an uncontested joint divorce or a traditional legal proceeding without speaking with an attorney to ensure that the agreement is comprehensive, enforceable and equitable.
